IP UKRAINE NOW 2022 organized by the Ukrainian Bar Association, one of the most anticipated fall events for the entire Ukrainian IP community took place on November 3, 2022.
The event began with address of IP lawyers who are currently defending Ukraine on the front lines. They unanimously expressed hope that next year they would be able to attend the conference in person and actively participate in the rebuilding of Ukraine on the professional front.
This year, the most pressing issues of the sphere were discussed during the conference, taking into account the realities of today - public policy and intellectual property reform, Ukrainian national office for intellectual property and innovations (UANIPIO) as a new stage in the reform, certification of patent attorneys in the EU, changes in the strategies of IP portfolio rightsholders after the start of a large-scale invasion, the issue of counterfeiting, a judicial way to protect intellectual property rights during martial law, etc.
Victoria Sopilnyak, partner of Doubinsky & Osharova, took part in the improvised battle "IP court - a real need or whim?" and expressed her arguments "FOR" the creation of a specialized court in Ukraine. In particular:
✅compliance with the principle of the reasonableness of the terms of consideration of cases;
✅the research depth of the disputed objects and improvement of the quality of IP justice;
✅legal certainty for right holders – ensuring an improved mechanism of judicial protection in the field of intellectual property rights;
✅ensuring the quality of justice will contribute to the development of innovations and increase the interest of innovative businesses in the Ukrainian market;
✅the experience of more than 30 countries testifies to the positive impact of the creation of specialized IP courts in the world
