On April 5, 2021, the National Association of Patent Attorneys of Ukraine discussed the draft order of the Ministry of Economic Development, Trade and Agriculture of Ukraine "On approval of the Rules of formation, submission of an application for a trademark, application for international registration of a trademark and examination of an application for a trademark, international registration of a trademark with extension to Ukraine".
Olga Leonchyk, patent attorney of Doubinsky & Osharova, board member of the National Association of Patent Attorneys of Ukraine, spoke in detail about the annexes to the draft Rules, new forms of documents, and some procedural issues. In particular:
- application form for the trademark, information it should contain, requirements for the image of the trademark, as well as the list of documents that must be attached to the application;
- expert opinions (on applications submitted under the national and international procedure), who should approve them and what information they should contain;
- decisions of the National Intellectual Property Authority (the Ukrpatent) taken on the basis of the approved expert opinion;
- suspension of terms of the applicant's submission of documents on payment of state duty for the issuance of a certificate and fee for publication on the issuance of a certificate in case of suspension of processing of the application (suspension of proceedings on the application) and appealing against the decision of the Ukrpatent by the person, who filed the opposition.
