On 5 July 2023, Victoria Sopilnyak, partner of Doubinsky & Osharova, participated in the online meeting "Ask NAPA", traditionally organised by the National Association of Patent Attorneys.
The meeting was devoted to the discussion of the Bolar exemption and proposed amendments to the Law of Ukraine "On Protection of Rights to Inventions and Utility Models".
Victoria spoke about the origin and nature of the exemption. She demonstrated how the so-called "Ukrainian Bolar" is applied in practical cases and highlighted the problems that arise from the different understanding of the regulatory provisions on pharmaceuticals and the provisions of intellectual property law in law enforcement.
At the end of her presentation, Victoria formulated a proposal to amend the Law of Ukraine "On Protection of Rights to Inventions and Utility Models".
