On December 14, 2021 Anastasia Kazankina Counsel at Doubinsky& Osharova, Chairman of the Intellectual Property Committee of the Ukrainian Advocates’ Association, held a webinar on "Measures to secure a claim in intellectual property matters."
After the Grand Chamber of the Supreme Court determined in the Decree of May 18, 2021 in case No. 914/1570/20 the possibility of cassation appeal of certain decisions on the adoption of measures to secure the claim the topic of the webinar became extremely relevant.
Anastasia analyzed actual judicial practice regarding similar cases and told the audience about:
- types of measures and the subject of securing a claim, components of the process of securing a claim, the nuances of the process of securing a claim in intellectual property rights cases;
- about what the court relies on and considers when securing a claim in IP cases;
- the position of the Supreme Court regarding the possibility of appealing decisions on the adoption of measures to secure a claim in the cassation instance.
Anastasia illustrated her speech with examples of practical cases from general judicial practice.
