BUSINESS PROTECTION 2021 - A2B FORUM, organized by the Ukrainian Advocates’ Association, was held On May 28, 2021. One of the tasks of the event was to discuss the most pressing issues and pitfalls of business protection: internal and external threats, features of business protection in certain areas.
Lawyer of Doubinsky & Osharova, Chairman of the Intellectual Property Committee of the Ukrainian Advocates’ Association Anastasia Kazankina outlined that the intellectual property can be an effective way to protect business on the Internet. During her speech at the Forum, Anastasia considered the typical violations on the Internet and drew the listeners' attention to the fact that the violations can be dealt with in court, as well as by using non-judicial means.
She told about each "place" of intellectual property infringements on the Internet and ways to fight them. In particular:
- domain names: UDRP procedure for a number of domains in the .UA zone;
- marketplaces: the marketplace’s application form, automated systems for receiving complaints;
- video platforms (YouTube): the rule of three strikes;
- social media: filing complaints on the platforms;
- torrents: submitting a complaint directly to the torrent.
In conclusion, Anastasia noted that all these mechanisms of protection of violated rights are valid only when the objects of IP rights are properly registered. And the most important thing: this should be done as one of the first steps when starting a business.
