IP Law talk

On May 25, Mykola Koval, attorney at law at Doubinsky and Osharova, took part in the IP Law Talk, organized by the Ukrainian Council of Young Lawyers together with the IP Office and the European University.

Mykola gave a workshop on the topic: "Fighting counterfeit goods during the war years" and shared with the audience his successful cases regarding this matter.

Mykola's report focused on the following issues, namely:

✅ statistical data of court criminal proceedings and verdicts in the periods "before" and "after" the introduction of martial law in Ukraine;

✅ question of jurisdiction of cases under Article 229 of the Criminal Code of Ukraine;

✅ compensation for material damage caused by improper use of objects of intellectual property rights;

✅New methodology for calculating pecuniary damage and its shortcomings according to clause 5.2.2, which is most suitable in the category of counterfeiting cases.

In addition, Mykola demonstrated copies of counterfeit goods in the photo and drew the attention of the audience to the practical trends in the completion of criminal proceedings in courts of first instance during martial law.
