The II National Forum on Intellectual Property and Innovation "IP Let Forum 2023” organized by the Ukrainian National Office of Intellectual Property and Innovation took place on December 1 and 2. The forum platform brought together representatives of the authorities, the international community and experts in intellectual property, law and economics, business, and creative industries in lively discussions.
Victoria Sopilnyak, partner of Doubinsky and Osharova joined the forum session "Sectoral Synergy: IP and Economic Sectors".
Victoria talked about the key challenges currently occurring in the pharmaceutical industry and the mechanisms of legal settlement that can be used in Ukraine to eliminate them.
Victoria focused the community's attention on the need to find points of contact to take into account the rights and interests of all stakeholders in the industry. There is a need to involve the experience of foreign jurisdictions to harmonize legislation, while national interests should also be taken into account.
"Original and generic pharma should coexist harmoniously. And the implementation of such coexistence depends on which mechanism will be chosen to settle the balance between the property rights of patent owners and the right to health care." - said Victoria.
