On November 27, the managing partner at Doubinsky & Osharova, Michael Doubinsky took part in the discussion of the topic "Intellectual property and pharmaceuticals" at the weekly event #askNAPA, organized by the National Association of Patent Attorneys of Ukraine.
Among the key issues discussed were the following:
- the need for strict compliance with protected patent rights by manufacturers of original medicines and all participants in the pharmaceutical market;
- the need of generic manufacturers for the possibility of obtaining registration certificates immediately after the expiration of the patent for the original medicines, which allows a quick entry to the market;
- analysis of the experience of the USA and the EU regarding the application of the "Bolar" exception and the justification of the need for its comprehensive implementation in the Law of Ukraine "On the Protection of Rights to Inventions and Utility Models".
Victoria Sopilnyak, partner at Doubinsky & Osharova also joined the discussion, highlighting the latest case law in the field.
