Advantages and Risks of the European Patent with Unitary Effect for Ukrainian Applicants: A Practical Case

Ukrainian Patent Attorney Kateryna Vaisberh, a specialist in national and international patent prosecution at Doubinsky & Osharova, has authored an article titled “Advantages and Risks of the European Patent with Unitary Effect for Ukrainian Applicants: A Practical Case” for Yurydychna Gazeta.

Based on a practical case involving a Ukrainian company, Kateryna analyses the economic feasibility of the Unitary Patent compared to traditional validation in EU countries, with particular focus on translation costs, official fees, annual maintenance fees, and the risks associated with the jurisdiction of the Unified Patent Court (UPC).

In addition, the author emphasizes that the Unitary Patent is subject to the exclusive jurisdiction of the Unified Patent Court (UPC). This means that a UP can be centrally challenged, potentially resulting in its revocation simultaneously across all participating countries, which entails certain risks.
