WIPO PROFF - tool for creating evidence

In the context of global digitalization of the economy and the more rapid development of all processes, the ability to prove the existence of a digital file at a specific point of time becomes crucial.

This new service designed by WIPO offers authors the possibility to protect better the digital output of their work and meets demands of the time.

Anastasia Kazankina, lawyer of Doubinsky & Osharova, Chairman of the Intellectual Property Committee of the Ukrainian Advocates’ Association, and Natia Mchedlishvili, Trademark Agent of Doubinsky & Osharova, spoke at a webinar WIPO PROFF - tool for creating evidence, held by the Intellectual Property Committee of the Ukrainian Advocates’ Association on 9th of August 2021.

Speakers talked about how WIPO PROOF works, how it could be used as a tool for creating evidence in court to protect the intellectual property rights, in particular:

  • What is a WIPO PROOF token and in what industries it can be used?
  • What is needed to create a token and how much does it cost?
  • A step-by-step algorithm for creating and paying for a token
  • Managing unpaid tokens
  • Premium Certificate - what is its purpose and how to obtain it?
  • How to verify the token?

Moreover, the participants of the webinar  became aware of the peculiarities of using the WIPO PROOF token as digital evidence in court from the point of view of the Ukrainian legislation, in particular:

  • What can be a digital evidence and what are the requirements for it?
  • Digital trust services, their varieties and legal force
  • Where and how to get an electronic signature?
  • Under what conditions paper copies of electronic evidence can be used in court?
  • Where to order the expertise in case it has been appointed by a court to establish and to fix the content of the webpage (website)?
  • Strength and weakness of using the WIPO PROOF tool to evidence in court.
