Legal Industry Reviews Ukraine: Hostile software ban: legal implications ahead"

Yana Yaroshevska and Olga Sopilnyak, attorneys-at-law at Doubinsky & Osharova, co-authored the article “Hostile software ban: legal implications ahead", published in the 9th edition of The Legal Industry Reviews Ukraine.

In the article, Yana and Olga analyse the provisions of Draft Law No. 13505 “On the Prohibition of the Use and Distribution of Hostile Software Products and Hostile Informatisation Tools”. The law provides for the creation of a registry of prohibited software, the definition of criteria for classifying products as “hostile,” and their gradual phase-out by January 1, 2030.

The authors highlight key changes that directly affect the business environment — in particular, that the draft law applies to both the public and private sectors. Businesses are encouraged to prepare in advance by conducting an audit of existing software, assessing potential risks, and planning a transition to secure solutions.

These new legislative initiatives aim to enhance the country’s cyber resilience and protect critical information systems.
