The event "Intellectual Property 2020: Reboot” at the Higher School of Advocacy of the National Bar Association of Ukraine

Partner of Doubinsky & Osharova Anton Koval spoke at the event "Intellectual Property 2020: Reboot” at the Higher School of Advocacy of the National Bar Association of Ukraine on December 11, 2020.

This training course was devoted to the changes in the system of legal protection of intellectual property of Ukraine, which took place in 2020.

Anton Koval focused on the issue in which he is one of the best specialists in Ukraine - the recognition of TM as well-known in court.

It is important for business to consider that:

  • recognition of a trademark as well-known is an additional important way to protect a trademark;
  • well-known TM is a valuable intangible asset of the company;
  • a well-known trademark status gives the right holder the opportunity to receive a significantly higher remuneration (royalty) for its use compared to the use of a trademark that has not been recognized as well-known;
  • the scope of legal protection of a well-known trademark is much wider in contrast to the usual registered trademark;
  • the well-known status of a trademark gives the right holder an effective ways to protect their rights in domain disputes;
  • recognition of a TM as well-known in court can be very effective for rights holders.
